None of us want to consider that one day we might be incapable of making decisions about our own health and financial affairs. Sadly, it is a position that more and more people find themselves in and so often without the necessary plans in place to allow the people who love and care for them to make decisions in their best interest.
By setting up a Lasting Power of Attorney, you chose your attorneys who will then be able to make decisions, when you are no longer able to do so, about your care, medical treatment, where you live, money management and if necessary the sale of your property. Without a Lasting Power of Attorney, if you lose the capacity to make your own decisions, an application will have to be made to the Court of Protection – the application can be both lengthy and costly and you cannot choose who they will appoint as your deputy. Even if you’re married or in a civil partnership, without a Lasting Power of Attorney your spouse cannot manage your finances or make decisions about your care.
