The Grant of Probate is a small but important part of estate administration and can be required where there is a valid and registered will, as well as where there is not. By obtaining the grant of probate, through the Probate Register, the executors have the authority to manage the affairs of the person who has died – which could include releasing funds from a financial institution or making arrangements regarding a house, buildings or land.

If assets are held jointly, then they automatically pass to the surviving partner and probate is therefore not required; the same applies to an estate of less than £5000.
